Terms of Service

1. Introduction

Welcome to Voice AI. These Terms of Service ("Terms") govern your access to and use of the Voice AI application, including all voice interaction features and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Voice AI Inc. ("we," "us," or "our"). Please read them carefully before using our Service.

2. Account Creation and Use

2.1. Registration Requirements

To access the full features of our Service, you need to create an account using your email address. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your account credentials confidential
  • Accept responsibility for all activities that occur under your account

2.2. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for restricting access to your device. You must notify us immediately of any unauthorized use of your account or any other security breach.

2.3. Age Restrictions

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to create an account and use our Service. By creating an account, you represent that you meet these age requirements.

3. Voice AI Services and Features

3.1. Voice-Based AI Interactions

Voice AI provides access to AI-powered voice conversation tools. The AI processes your voice inputs, generates responses based on the information you provide, and delivers responses using synthesized speech. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.

3.2. Voice Recognition and Processing

Our Service uses voice recognition technology to understand your spoken requests. By using the Service, you acknowledge and consent to:

  • The recording and processing of your voice for the purpose of understanding your requests
  • The conversion of your speech to text for AI processing
  • The generation and delivery of AI responses through synthesized speech

3.3. Service Availability

While we strive to provide uninterrupted service, we cannot guarantee that the Service will be available at all times or error-free. We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time without notice.

4. User Content and Voice Data

4.1. Voice Content Ownership

You retain ownership rights to the content of your voice interactions submitted through our Service ("Voice Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, process, and analyze such Voice Content for the purpose of providing and improving our Service.

4.2. Content Restrictions

You may not use the Service to create or transmit Voice Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes or violates any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Contains software viruses or any other malicious code
  • Interferes with or disrupts the integrity or performance of the Service
  • Attempts to gain unauthorized access to any part of the Service

4.3. Content Monitoring

We reserve the right, but have no obligation, to monitor and review Voice Content for compliance with these Terms. We may remove or refuse to process any Voice Content that violates these Terms or that we find objectionable for any reason.

5. Data Processing and Authentication

5.1. Data Collection and Processing

When you use our Service, we collect and process certain information as described in our Privacy Policy. This information is essential for providing and improving the Service, ensuring security, and complying with legal requirements.

5.2. Firebase Authentication

Our Service uses Firebase for user authentication and device identification. Your use of the Service implies consent to the use of Firebase for these purposes, subject to Google's terms and privacy policies.

5.3. Voice Data Processing

Voice data processing includes:

  • Converting speech to text for AI processing
  • Analyzing voice patterns for improved recognition (if you opt in)
  • Generating text-to-speech responses
  • Storing conversation history according to your preferences

6. Subscription and Payment Terms

6.1. Free and Premium Services

Voice AI may offer both free and premium features. Access to premium features requires payment according to our current pricing structure.

6.2. Apple Subscription Terms

  • Subscription fees are charged through your Apple ID account
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store

6.3. Payment and Billing

  • You agree to pay all fees and charges associated with your subscription
  • All payments are processed and managed by Apple, subject to Apple's terms and conditions
  • Payment information is stored by Apple, not Voice AI
  • Refunds are handled according to Apple's refund policies

7. Intellectual Property Rights

7.1. Ownership of Service

The Service, including all software, voice processing algorithms, visual interfaces, graphics, design, compilation, information, data, and all other elements of the Service, is owned by us or our licensors and is protected by copyright, trademark, patent, and other intellectual property laws.

7.2. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

7.3. Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service

8. User Obligations and Prohibited Activities

8.1. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Impersonate any person or entity or falsely state or misrepresent your affiliation
  • Engage in any activity that interferes with or disrupts the Service
  • Attempt to gain unauthorized access to the Service or related systems

8.2. Voice Recording Limitations

You may not:

  • Record or store voice interactions with the Service for redistribution
  • Use automated systems to generate voice inputs
  • Attempt to manipulate the voice recognition system through artificial means

8.3. Security Testing

You may not perform security vulnerability testing on the Service without our explicit written permission.

9. Limitation of Liability

9.1. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2. Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
  • MISINTERPRETATION OF VOICE COMMANDS OR ACCURACY OF VOICE RECOGNITION

9.3. Limitation of Damages

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO PREMIUM FEATURES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Termination

10.1. Termination by User

You may terminate your account at any time through your account settings or by contacting customer support. Subscription cancellations must be managed through your Apple ID account settings.

10.2. Termination by Voice AI

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Non-payment of any fees owed
  • Extended periods of inactivity

10.3. Effect of Termination

Upon termination:

  • Your right to use the Service will cease immediately
  • Your subscription will be cancelled according to Apple's subscription terms
  • We may retain certain information as required by law or for legitimate business purposes
  • You may request deletion of your data according to our Privacy Policy

11. Disclaimers and Warranties

11.1. Voice Recognition Accuracy

While we strive for accuracy in voice recognition, we do not warrant that the Service will correctly interpret all voice inputs. Factors such as accent, background noise, pronunciation, and technical limitations may affect accuracy.

11.2. AI-Generated Content

AI-generated responses may not always be accurate, complete, or appropriate. You acknowledge that you use such content at your own risk and discretion.

The Service may reference or connect to third-party websites or services. We are not responsible for the availability or accuracy of such external sites or resources.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within California for the resolution of any disputes.

13. Changes to Terms

13.1. Modification Rights

We reserve the right to modify or replace these Terms at any time at our sole discretion.

13.2. Notification of Changes

We will make reasonable efforts to notify you of any material changes by:

  • Posting a notice on our website or within the Service
  • Sending an email to the address associated with your account
  • Other reasonable means

13.3. Continued Use

Your continued use of the Service after any such changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

14. Miscellaneous

14.1. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

14.2. Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

14.3. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms at our discretion.
