Terms of Service

1. Introduction

Welcome to Snowy. These Terms of Service ("Terms") govern your access to and use of the Snowy application and related features (the "Service"). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Snowy is a ski and snowboard tracking app. It records sessions using your device's location hardware, calculates run statistics such as vertical, distance, and speed, and provides features including a season logbook, resort maps and conditions, achievements, run replays, offline map downloads, and optional social features such as friends, crews, messaging, and live location sharing.

3. Eligibility

You must be at least 13 years old, or the minimum legal age in your jurisdiction, to use the Service.

4. Safety on the Mountain

This section is important. Please read it.

Snowy is a recording and planning tool. It is not a safety device. The Service does not detect falls, call for help, summon ski patrol, or monitor your wellbeing.

You agree that:

You are solely responsible for your own safety and for riding within your ability
You will follow the rules, signage, closures, and boundary markings of the resort you are at
You will not rely on Snowy in place of a resort trail map, ski patrol, avalanche forecasting, official conditions reporting, or professional instruction
You will not use the app in a way that distracts you while moving, and will not operate your device while riding
You will not treat speed, vertical, or any other statistic as a target to chase

Skiing and snowboarding carry inherent risks, including serious injury and death. Speed and vertical figures in Snowy are personal records only. Nothing in the Service is an encouragement to ride faster, ride terrain beyond your ability, cross closures, or enter uncontrolled or backcountry terrain.

5. Accuracy of Tracking and Resort Information

Location and elevation data come from your device's hardware and are affected by terrain, tree cover, weather, device conditions, and satellite availability. Run detection, vertical, distance, speed, and elevation figures are estimates and may be inaccurate or incomplete.

Resort details, trail maps, conditions, and weather are provided for convenience, may come from third-party sources, and may be out of date or incorrect. Always confirm current conditions, terrain status, and closures with the resort itself.

You agree not to rely on the Service for navigation, terrain assessment, or any decision where an error could cause harm.

Live location sharing is optional and off unless you enable it. If you turn it on, friends you have accepted may see your position on the mountain map while you ride. You are responsible for deciding whether to share your location and with whom, and you can disable sharing at any time.

When using friends, crews, messaging, or activity features, you agree not to harass, threaten, impersonate, or abuse other users, not to post unlawful or infringing content, and not to use another person's location information to follow, surveil, or endanger them. We may remove content or suspend accounts that violate these rules.

Messages are not end-to-end encrypted. Do not use them for confidential information.

7. Your Responsibilities

You agree to:

Keep your account credentials secure
Provide accurate account information
Use the Service only for lawful purposes
Refrain from reverse-engineering, interfering with, overloading, or attempting unauthorized access to the Service
Refrain from using automated systems to access the Service outside authorized interfaces
Refrain from submitting falsified activity data or otherwise manipulating statistics, leaderboards, or achievements

8. Snowy Pro and Purchases

Snowy offers free features and a paid upgrade, Snowy Pro, which includes per-run stats and advanced analytics, run comparisons, run replays on the 3D mountain, and unlimited offline map areas.

Billing: Snowy Pro is sold as an auto-renewing subscription through the App Store. Payment is charged to your Apple Account at confirmation of purchase.
Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Cancellation: You can cancel anytime in your App Store account settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled by Apple under Apple's policies. We cannot issue refunds directly.
Family Sharing: Family Sharing eligibility, where offered, is managed through Apple.
Free tier limits: Free accounts may have limits on features such as the number of saved offline map areas.

We may change, improve, or discontinue free or paid features at any time, subject to applicable law.

9. Your Content and Data

You retain ownership of the runs, routes, photos, messages, and other content you create in Snowy. You grant us a limited license to store, process, and display that content solely to operate the Service for you and to deliver it to the people you choose to share it with.

You can export your runs as GPX files and export your account data from within the app.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how location and other information is handled in Snowy and is incorporated into these Terms by reference.

11. Intellectual Property

The Service and its components, including software, design, graphics, and trademarks, are the property of AGI Applications or its licensors. Resort names, logos, and trail map materials remain the property of their respective owners and are used for identification purposes only. Snowy is not affiliated with, endorsed by, or sponsored by any resort unless expressly stated.

12. Third-Party Platforms and Services

The Service relies on Apple device features and account services, and on third-party providers for functions such as authentication, hosting, notifications, weather data, maps, and purchase processing. Your use of those services is governed by their own terms and privacy policies, and their availability is outside our control.

Apple is a third-party beneficiary of these Terms with the right to enforce them.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that tracking, run detection, statistics, replays, maps, offline downloads, conditions, notifications, location sharing, or sync will be uninterrupted, accurate, complete, or available at any given time. Battery life, device performance, signal availability, and cold-weather behavior may affect recording.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Termination

We may suspend or terminate access to the Service if you violate these Terms or misuse the Service. You may stop using the Service at any time by uninstalling the app and discontinuing use.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
