1. Introduction

Welcome to PDF Merger. These Terms of Service ("Terms") govern your access to and use of the PDF Merger application, services, and features (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and PDF Merger LLC ("we," "us," or "our"). Please read them carefully before using our Service.

2. Service Use and Age Restrictions

2.1. Age Restrictions

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use our Service. By using the Service, you represent that you meet these age requirements.

2.2. Apple Subscription

Our Service uses Apple's subscription system to verify premium feature access. We do not create or maintain separate user accounts. Your subscription status is tied to your Apple ID and managed through your Apple account settings.

3. PDF Merger Service and Features

3.1. PDF Processing

PDF Merger provides tools for combining multiple PDF documents into a single file. All document processing occurs locally on your device - your PDF files are never transmitted to our servers for processing.

3.2. Local Processing

Our Service is designed to process documents entirely on your device. You acknowledge that:

  • Document quality and processing results depend on your device capabilities
  • Processing time may vary based on document size and complexity
  • We cannot access or view the content of your documents

3.3. Service Availability

While we strive to provide uninterrupted service, we cannot guarantee that the Service will be available at all times or error-free. We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time without notice.

4. User Content and Data

4.1. Document Ownership

You retain full ownership rights to all PDF documents you process through our Service. We do not claim any ownership rights to your documents.

4.2. Local Storage

All document processing occurs locally on your device. We do not:

  • Store copies of your documents on our servers
  • Maintain archives of your merged PDFs
  • Access the content of your documents
  • Transmit document data over the internet

4.3. Content Restrictions

You may not use our Service to process or create documents that:

  • Are illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe or violate any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Contain malicious code or attempt to interfere with the Service
  • Violate any applicable laws or regulations

5. Privacy and Security

5.1. Privacy Policy

Our handling of any user data is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using our Service, you consent to the collection and use of information as detailed in our Privacy Policy.

5.2. Document Security

While we implement reasonable security measures within our application, you acknowledge that:

  • We cannot control the security of your local device
  • You are responsible for maintaining the security of your device and files
  • No method of electronic storage or transmission is 100% secure

6. Subscription and Payment Terms

6.1. Free and Premium Features

PDF Merger may offer both free and premium features. Access to premium features requires payment according to our current pricing structure.

6.2. Subscription Terms

  • All subscriptions are processed and managed by Apple through the App Store
  • Subscription fees are charged to your Apple account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase

6.3. Payment and Billing

  • All payments are processed by Apple, not by PDF Merger
  • Billing disputes should be directed to Apple Support
  • We do not store payment information as all transactions are handled by Apple
  • All payments are non-refundable except as expressly provided in these Terms, Apple's terms, or as required by law

7. Intellectual Property Rights

7.1. Ownership of Service

The Service, including all software, visual interfaces, graphics, design, compilation, information, data, and all other elements of the Service, is owned by us or our licensors and is protected by copyright, trademark, patent, and other intellectual property laws.

7.2. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

7.3. Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service

8. User Obligations and Prohibited Activities

8.1. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Impersonate any person or entity or falsely state or misrepresent your affiliation
  • Engage in any activity that interferes with or disrupts the Service
  • Attempt to gain unauthorized access to the Service or related systems

8.2. Automated Access

You may not use any automated system or software to extract data from the Service for commercial purposes ("screen scraping") without our prior written consent.

8.3. Security Testing

You may not perform security vulnerability testing on the Service without our explicit written permission.

9. Limitation of Liability

9.1. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2. Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

9.3. Limitation of Damages

IN ANY CASE, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO PREMIUM FEATURES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

9.4. Document Processing Limitations

You acknowledge and agree that:

  • We do not guarantee the quality or accuracy of merged PDF documents
  • Results may vary based on the nature and formatting of your original documents
  • The Service may have limitations in handling certain PDF features or elements
  • You are responsible for verifying the accuracy and completeness of merged documents

10. Termination

10.1. Termination by User

You may terminate your subscription at any time through your Apple account settings. Termination of your subscription will be subject to Apple's terms.

10.2. Termination by PDF Merger

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

10.3. Effect of Termination

Upon termination, your right to use premium features of the Service will cease immediately.

11. Disclaimers and Warranties

11.1. Accuracy of Information

While we strive for accuracy, we do not warrant that the Service will be error-free or uninterrupted, or that defects will be corrected.

11.2. Document Processing

We do not guarantee that the Service will:

  • Process all PDF documents successfully
  • Maintain all formatting and features of original documents
  • Be compatible with all PDF versions or non-standard PDF implementations

The Service may contain links to third-party websites or resources. We are not responsible for the availability or accuracy of such external sites or resources.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within California for the resolution of any disputes.

13. Changes to Terms

13.1. Modification Rights

We reserve the right to modify or replace these Terms at any time at our sole discretion.

13.2. Notification of Changes

We will make reasonable efforts to notify you of any material changes by:

  • Posting a notice on our website or within the Service
  • Sending an email to the address associated with your account
  • Other reasonable means

13.3. Continued Use

Your continued use of the Service after any such changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

14. Miscellaneous

14.1. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

14.2. Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

14.3. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms at our discretion.
