Terms of Service

1. Introduction

Welcome to 3D Mockup. These Terms of Service ("Terms") govern your access to and use of the 3D Mockup application and related features (the "Service"). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

3D Mockup is a design app for creating product mockups. It provides a 3D and flat 2D editor, artwork placement, layers, text and drawing tools, product colouring, lighting and backdrops, image, video, and 3D file export, an optional AI generation studio, and optional community and marketplace features.

3. Eligibility

You must be at least 13 years old, or the minimum legal age in your jurisdiction, to use the Service.

4. Accounts

You may use the Service as a guest or create an account by signing in with Apple or an email address. You are responsible for keeping your account credentials secure and for activity that occurs under your account. Guest data is tied to your device and may be lost if the app is removed.

5. Your Content

You retain ownership of the artwork, designs, projects, text, and other content you create or upload in 3D Mockup.

You grant us a limited license to store, process, and display that content solely to operate the Service for you — for example, to render your mockup, sync your projects, and show your posts to the people you publish them to. This license ends when you delete the content, except for copies retained in backups for a limited period.

You are responsible for having the rights to the artwork you upload. Do not upload designs, logos, photographs, fonts, or trademarks you are not licensed to use. You are solely responsible for the mockups you produce and how you use them commercially.

6. Acceptable Use

You agree not to:

Upload or publish unlawful, infringing, hateful, harassing, or sexually explicit content
Impersonate another person or misrepresent your affiliation with a brand
Harass, threaten, or abuse other users
Reverse-engineer, interfere with, overload, or attempt unauthorized access to the Service
Use automated systems to access the Service outside authorized interfaces
Attempt to circumvent credit limits, entitlement checks, or device integrity checks

We may remove content or suspend accounts that violate these rules.

7. AI Generation

The Service includes optional AI generation features. Prompts and attached images are processed by a third-party AI service to produce a result.

You agree that:

You will not use AI generation to produce unlawful or infringing content, or to imitate a specific living artist's or brand's protected work in order to pass it off as theirs
AI output is generated automatically and may be inaccurate, unexpected, or unsuitable for your purpose
You are responsible for reviewing AI output before using it commercially

AI generation is metered by credits. Credit balances have no cash value, are not transferable, and are not redeemable for money.

8. Community and Marketplace

If you publish to the community or operate a storefront, you are responsible for the content, descriptions, and images you post, and for accurately representing anything you offer.

We provide the platform, not the transaction between users. Where the Service facilitates listings between creators and buyers, we are not the seller of those items, and we are not responsible for the quality, legality, fulfilment, or delivery of goods offered by other users, except as required by law.

9. Purchases

3D Mockup offers free features, a paid premium subscription, and one-time credit packs for AI generation.

Billing: Purchases are processed through the App Store. Payment is charged to your Apple Account at confirmation of purchase.
Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Cancellation: You can cancel anytime in your App Store account settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled by Apple under Apple's policies. We cannot issue refunds directly.
Credits: Credit packs are one-time purchases, consumed as you generate, and are non-refundable once used except where required by law.
Family Sharing: Family Sharing eligibility, where offered, is managed through Apple.

We may change, improve, or discontinue free or paid features at any time, subject to applicable law.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how your information is handled and is incorporated into these Terms by reference.

11. Intellectual Property

The Service and its components, including software, design, graphics, bundled 3D models, and trademarks, are the property of AGI Applications or its licensors. Bundled product models are provided for use inside the Service to create mockups; you may use the mockups you export, including commercially, but you may not extract, redistribute, or resell the underlying 3D models themselves.

Product shapes are generic representations. Brand names, logos, and trademarks belonging to third parties are not included, and 3D Mockup is not affiliated with, endorsed by, or sponsored by any apparel or product brand.

12. Third-Party Platforms and Services

The Service relies on Apple device features and account services, and on third-party providers for functions such as authentication, hosting, notifications, AI generation, and purchase processing. Your use of those services is governed by their own terms and privacy policies, and their availability is outside our control.

Apple is a third-party beneficiary of these Terms with the right to enforce them.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that rendering, exporting, AI generation, sync, the community, or the marketplace will be uninterrupted, accurate, complete, or available at any given time. Rendered mockups are representations and may differ from a physically produced product in colour, scale, texture, or print placement. Do not rely on a mockup as a production proof.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Termination

We may suspend or terminate access to the Service if you violate these Terms or misuse the Service. You may stop using the Service at any time by deleting your account in Settings and uninstalling the app.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
